THE REAL STORY WITH IVANHOE

I first met Ivo van Baal, who also calls himself Ivanhoe,
less than a week before my annual business closure
(21.12.2024 to 11.01.2025).
He came with his BMW R1200GS, on Dutch license plate,
to my shop and told me that the rubber cover of the
steering ball joint needs replacement.
He asked if he could do it himself as he had experience
in maintenance of his motorcross bike and doing service on
this BMW.
When I saw that the protective rubber cover was completely
worn/torn and that the bike had run just over 100.000 kms,
I advised him against it.
In Holland where I have worked for 25 years as a motorbike
technician at a BMW dealership, know that this rubber part
cannot be ordered separately.
Thus does not have its own OEM (BMW original Article code
number), it forms part of the complete Steering Ball joint.
BMW does this for safety reasons, because if the rubber
cover is worn, damaged, it can also apply to the Steering
Ball Joint, and then there is a risk that the steering
ball will fly out of the head, resulting in the motorbike
becoming uncontrollable.
I offered him to do the job, replacing the steering ball joint,
after which he left my premises with his motorbike, to think
about it......


On December 17th 2024 he calls and gives me the order
to replace the steering ball joint (see pict. above).
I asked him to make a deposit of E 100,- so that I can order the
parts (at BMW Fersan, area dealer) in advance.
Next day, he gave me the deposit (with note) but also needs the repair
of the center stand, of which the mounting bolt has broken off.

On December 19th I asked BMW Fersan for prices and
delivery time of the parts (above picture).
Because the delivery time was 3 days, I decided to wait to order
until I come back from holidays.
The parts were received January 16th in anticipation
of the delivery of the motorbike.
I couldn't reach IvB, because he didn't leave a phone number,
I called here and there, searched the internet, living in Javea.
After 14 days I called several dutch clients and still no show.
I was worried that I would be left with the costs (-/- 100 Euro), this
has happened before.
At BMW Fersan, I have 30 days after delivery to return parts in the
original packaging.
It wasn't until 3rd week of February that he called
me, almost immediately asking a quote for a new front tire for his BMW,
he mentioned type and brand.
It turned out to be a cross tire and not suitable for his motorcycle,
because the speed indication does not correspond with what is allowed
for motorbike.
There is a great risk that the tire will burst because a cross tire cannot
handle the high speed of the motorcycle.
He said he did want to take the risk, but I refused to deliver and mount.
If he sells the motorbike with the cross tire and the next rider goes fast,
life-threatening situations can arise.
I informed him by phone (February 21st), he had to think
about it and hung up.
Finally I called him March 11th, when he would come to have the
motorbike in the workshop for the repair.
March 12, it was delivered and booked next day in the
workshop, and I finished the work on 14 March.
On 18th March I made the testdrive/roundabout on the N332,
then through Pedreguer town, and again back on the N332, about 8 kms.
The specified Work Order no. 3352 (I started 17 years ago here in Spain
with Orderno. 0001) has been made.
On March 19, 11.23 I called that the BMW was
ready and informed him of the invoice amount.
His response was Ok, I will come tomorrow (March 20th) to
pay and pick it up.
But a few hours later, just before closing time (2:00 PM) of the store,
he surprised me with a visit, asking for an explanation for the invoice
amount, that he said is far much too high as he expected to be.


I showed him the Invoice and Work Order/Albaran, with specifications
of material and labourhours and the total costs incl. VAT.
I explained that I needed more time (1.5 hours) to place the new ball joint.



His BMW R1200GS (production date 2006) is equipped with servo brakes
(so-called generation 1), see pictures above.
BMW renewed system (generation 2) came around 2007, which made
it easier to bleed the system.

I wanted him to see above pictures on my iPad which I always
make for repairs that cannot be seen when the work is finished,
but he didn't even show any interest in it, nor did he wanted
to see the replaced steering ball joint with worn/torn cover
(see above picture).
Just before he left, he requested the invoice to be sent by
email to invited@xs4all.nl, which I did.
March 20, 12:15 PM I sent the work order/Albaran
and a copy of the invoice by email and at 9:33 PM received the first
(of 9 emails) with all kinds of unjustified accusations,
written response of an inflated, unjustified, invoice for
unnecessary work, and he sends me links with YouTube videos
on how I could do the work more economically and in fact,
he could have done the job himself.
A few days later, he comes by during the store opening in his
motorcross outfit with a motocross bike
and wants to negotiate the amount of the invoice, as is normal
in the construction world, according to him.
He casually mentioned his interest in a jacket from the showroom
motorbike clothing collection, maybe as a gift or a discount and
and I did not respond to any of that.
He left the store again before being told that it is a justified
invoice, that will not be corrected on my expenses, to be paid first,
on which he could take the bike away.
In one of his later emails, he mentioned I was taking the bike hostage
and someone of his friends told him it was seen on the road.
(Could it be the 8 kms testdrive I made??!!) that was explained by
Ivo van Baal of fundriving or renting out.



For sure I wouldn't even think about it, his bike when it was
in my workshop platform, had all the signs of being used
on cross terrain, (see also above 1st picture) and a lot of rust,
standing long nearby the sea (owner lives in Javea?).
When the bike is out the workshop, the Workorder/Albaran was completed with tacho
105296 km.(see.picture Work Order).
After the testdrive, March 18th, of 8 km, tacho 105304km.

Bike is picked up directly from storage by new owner, with the same km-tacho.

IvB is unaware that for vehicle garages, there is the so-called Right of Retention.
This is written in Law Garage Management (In Spain and also in Holland):
A garage owner has a right of retention on a repaired car/motorbike if the
customer does not pay the bill.
This means that the garage owner may hold on to the car/motorbike until
the customer has paid the invoice.
The right of retention is a means for the garage owner to enforce payment.

March 28 10:35 I called him, no response
April 1 11:24 He returned my call and I kindly ask him when
he will come to pay the invoice and then get the bike, but before I could say
"If the invoice is not paid within 1 week, the bike will go
into storage area on April 8, at 1 euro per day, as it is still in
the workshop area, hampering my space movements."
His last words were "You will notice that" and
ended the connection.
April 1st, 11.52 hr I sent him Text message to repeat what
he said(above pict).
And on April 8 10.48 I sent the following text message.
Would you please pay your Invoice this week, and pick up your motorcycle up.
From next Monday I charge storage costs. 1 Euro per day, 30 euros per month.
So, what I expected, beginning of May 3x a 1-star reviews given, see
Peter Zwaan Motorbikes/Google Review.
On May 10th one of my customers comes into the shop and
says he bought the bike from IvB, and payed the Invoice (on behalf of IvB??)
which I signed as paid.

In his presence I removed the bike from the storage location
(see above picture) and he drives away with the bike.
And then, when you think, it is finally over, a lot of other mails followed
from Ivanhoe, that the BMW is brought to another workshop for
2nd opinion where they concluded that I damaged the cardan of the motorbike,
as it is making a lot of noise, due to my renting out/fundriving??????
In my opinion, if you use a BMW GS as a motorcrossbike, then for sure you
have to accept the consequences. But in this case it is no longer his
problem as he sold it....... .
What I do wonder, why he drives here around on a motorbike with
a Dutch license plate (registered in his name in Amsterdam/Holland)
living in Javea. I know that in Holland there is NO,
so-called APK-test for motorbikes, only for cars.
Spain and more European countries, has the ITV-test every 2 years
for a motorbike.
So there is no need to transport/drive the motorbike regurlaly back
to Holland.
But what happens if he got involved in an accident??

Extra technical information about replacing the Steering Ball Joint
The brake line must be disconnected, which in turn requires bleeding
the front brake.
To access the brake fluid reservoir, the fuel tank must first be removed
on the bike (generation 1),
then the bleeding procedure (diagram) can be performed.
